Building Permits

Building permits are required for most types of construction within Viola Town Limits. Generally, a Compliance Letter is issued by the town stating that a project meets the town’s zoning requirements which is taken to Kent County Division of Permitting and Enforcement which issues the official building permit. Buildings (homes & businesses) are required to go before the Viola Planning & Zoning Committee who recommends to the Board of Commissioners whether a Compliance Letter should be issued. Once approval is given by the Board of Commissioners, a Compliance Letter is issued which must be brought to Kent County to receive a permit.

Accessory Projects – The following Compliance Letters may be issued by the Town Manager if all zoning requirements are met. This Compliance Letter must also be brought to Kent County for an official building permit(s):

  • Fences
  • Sheds
  • Decks
  • Pools

Failure to comply with building permits and/or zoning regulations can results in fines, liens, and civil litigation.

Below are the current Planning and Zoning Fees for FY2025. These fees are valid from July 1, 2024, to June 30, 2025.

  • Project Permit(s) for projects estimated to cost less than $5,000 cost $25.00 (payable via Check, Money Order, or Cash)
  • Project Permit(s) for projects estimated to cost more than $5,000 will cost 0.5% of the total cost of the project (payable via Check, Money Order, or Cash); Must include project estimate documentation.
  • Contractor’s license application cost $100 annually.
